Protect Your Position. Recover What You’re Owed.

The construction industry moves fast, involves multiple parties, and operates on tight margins. When disputes arise – over payment, scope of works, delays, or defects – they escalate quickly and hit cash flow hard.

At Clutch Legal, we act for builders, contractors, subcontractors, developers, property owners and body corporates involved in building and construction disputes across Queensland. We provide strategic advice and representation designed to protect your legal position and get matters resolved without unnecessary delay.

The Reality of Construction Disputes

Construction disputes in Queensland are common, and they’re rarely straightforward. Projects involve layers of contracts, multiple parties with competing interests, and strict timeframes that leave little room for error. When something goes wrong – unpaid invoices, defective works, scope disputes, or project delays – the financial and operational consequences can be severe.

These disputes often involve parties who need to continue working together, at least in the short term. That creates tension between resolving the legal issue and maintaining working relationships. Our role is to navigate that tension strategically, protecting your interests while keeping commercial realities front and centre.

Delays, extensions of time, and liquidated damages claims

Breach of contract and termination disputes

Security of Payment and Adjudication

Queensland’s security of payment legislation provides a fast-track process for resolving payment disputes in the construction industry. The regime is designed to keep cash flowing through projects by allowing contractors and subcontractors to pursue adjudication of payment claims on a tight timeframe.

We regularly assist clients with security of payment claims, payment schedules, adjudication applications, and responses. The adjudication process is strictly procedural and unforgiving of mistakes – deadlines are short, the rules are technical, and getting it wrong can be costly.

Whether you’re pursuing payment or responding to a claim, we provide clear guidance on the adjudication process, prepare and lodge applications properly, and represent your interests throughout. We also advise on enforcement of adjudication decisions and, where appropriate, challenging decisions through judicial review.

QCAT and Court Proceedings

Not all building disputes fit within the adjudication framework. Many matters – particularly residential building disputes involving defects, incomplete works, or contractual disagreements – are resolved through the Queensland Civil and Administrative Tribunal (QCAT) or court proceedings.

We represent clients in QCAT’s building and construction stream, handling domestic building disputes and other tribunal matters. We also act in District Court and Supreme Court proceedings where disputes involve larger commercial projects, complex contractual issues, or enforcement of judgments and adjudication decisions.

Defects, Delays, and Incomplete Works

Disputes over defective or incomplete works are among the most common – and most frustrating – issues in the construction industry. For property owners, these disputes often involve significant financial exposure and uncertainty about whether the project will ever be completed properly. For builders and contractors, they involve defending workmanship, managing scope creep, and protecting against unfair or exaggerated claims.

We assist property owners pursuing claims for defective works, incomplete construction, and cost of rectification. We also represent builders and contractors defending claims, negotiating practical resolutions, and enforcing contractual rights where owners have failed to meet their payment obligations.

Our Approach

Construction disputes require speed, technical understanding, and commercial pragmatism. We focus on protecting your cash flow, enforcing your contractual rights, and resolving disputes efficiently without losing sight of the commercial outcome you’re trying to achieve.

Where possible, we pursue resolution through negotiation or structured dispute resolution. But we don’t hesitate to escalate when necessary – whether that’s commencing adjudication, lodging tribunal claims, or issuing court proceedings. The key is knowing when to push and when to hold back, and we make those calls based on your commercial priorities and the strength of your legal position.

You’ll always understand where your matter stands, what the next steps are, and what the realistic prospects and costs look like. We don’t overcomplicate the process or generate unnecessary work – we focus on getting results.

When to Get Advice

Timing matters in construction disputes. Security of payment deadlines are strict, adjudication windows are short, and delay can weaken your position or limit your options. The earlier you get legal advice, the more leverage you have and the more paths remain open.

If you’re dealing with unpaid invoices, defective works, project delays, or any other building and construction dispute in Queensland, contact our team today. We’ll assess your position, explain your options, and help you move forward strategically.
